LEGAL PLAN OF ACTION

The National Executive Committee (NEC) of the Social Democratic Front (SDF) meeting today 9th March, 1996 at Bamenda has authorised the Legal Department of the Party to take legal action against the government concerning the appointment of Government Delegates, as follows :

Action to declare Ultra Vires the powers of the President of the Republic to appoint Government Delegates in Urban Councils with Special Status and in the metropolis of Douala and Yaounde.

This action is based on :

  1. violation of Articles 21 and 30 of the Universal Declaration of Human Rights proclaimed by the United Nations and ratified by Cameroon;

  2. violation of Article 65 of the Cameroon Constitution of 18th January, 1996 which makes the preamble an integral part of the Constitution;

  3. violation of the General Principles of law;

  4. violation of Articles 2, 55 and 68 of the Cameroon Constitution of 18th January, 1996.

PROCEDURE :

  1. ANNULMENT

    1. Address petitions to the appropriate authority that has violated the above legal provisions;

    2. Commence an action in the Supreme Court for interim remedies of the above petition.

  2. SEPARATE ACTIONS

    Institute separate actions for the Supreme Court to declare as obsolete the following legal provisions :

    1. Decree no 93.322 of 25th November, 1993 modifying and completing certain provisions of Decree no 77/203 of 29th June, 1977 fixing the Councils and their territorial limits;

    2. Decree no 74/077 of 28th April, 1994 determining the composition of Municipal Executives of Councils with Special Status;

    3. Decree no 87/1365 of 24th September, 1987 concerning the creation of the metropolis of Yaounde;

    4. Decree no 87/1366 of 24th September, 1987 concerning the creation of the metropolis of Douala.

  3. LITIGATIONS

    Litigations before the Constitutional Council for the unconstitutionality of the following :

    1. Law no 87/15 of 15th July, 1987 concerning the creation of Urban Councils;

    2. Law no 74/23 of 5th December, 1974 concerning the organisation of the Councils as stated in Articles 172 and 177.
