PRIVATE MEMBERS’ BILL FOR THE AMENDMENT OF HE CONSTITUTION OF CAMEROON TABLED BY THE UNDERSIGNED IN ACCORDANCE WITH THE PROVISIONS OF SECTION 63 (1) & (2) OF THE CONSTITUTION OF THE REPUBLIC OF CAMEROON AND THE STANDING ORDERS OF THE NATIONAL ASSEMBLY

EXPLANATORY STATEMENT

Some provisions of the Constitution of the Republic of Cameroon (Law No. 96/06 of 18 January 1996) need to be amended to enable this fundamental law respond to the profound aspirations of the Cameroonian people and to establish a democratic basis for the life of the institutions and people of Cameroon. For the moment, we the undersigned, members of parliament in the National Assembly hold that the most vital step in this regard consists of the election of the President of the Republic and the conduct of that election.

Thus proposals for the amendment of section 6 & 48 of the Constitution are hereby made.

In respect of section 6, the election of the president on a two-round majority ballot, avoids a President being elected for example with a 20% votes cast as against 80% of Cameroonians who might have voted against him or her.

This is the likely consequence of the present constitutional provisions.

Whereas, a second round ballot would avoid major dissentions through alliances and consequently the harmonisation of programmes of government;

As far as section 48 is concerned, transparency and objectivity which should contribute in the establishment of a democratic tradition in our country must draw its dynamism from the Constitution.

PART II: EXECUTIVE POWER
CHAPTER ONE: THE PRESIDENT OF THE REPUBLIC

Article 6:
1. The President of the Republic shall be elected through direct equal and secret universal suffrage on a two round majority ballot.
2. The President is considered elected on the first round if a candidate obtains an absolute majority of the votes cast.
3. If after the first round of ballot, no candidate obtains an absolute majority of the votes cast, a second round ballot is conduced through which is considered elected, the candidate who has obtained a simple majority of the votes cast.
4. Only the first two candidates who obtain the highest number of votes cast in the first round of ballot shall take part in the second round of ballot, and this second round ballot shall be conducted on the third Sunday following the date of proclamation of the results of the first round ballot.
5. The President of the Republic shall be elected for a term of five (5) years and shall be re-eligible once.

PART VII: THE CONSTITUTIONAL COUNCIL AND THE NATIONAL AUTONOMOUS ELECTORAL COMMISSION

Section 48 (1) (a) The Constitutional Council shall ensure the regularity of the election of Municipal and Regional Councillors, election of members of Parliament, election to and vacancy of the Presidency of the Republic, referendum operations.

Section 48 (1) (b) It is hereby established a National Independent Electoral Commission charged with the organisation of the election of Municipal and Regional Councillors, election of members of parliament, election to and vacancy of the Presidency of the Republic, referendum operations. It shall proclaim the results thereof.

The organisation, functioning, composition and duties of the National Independent Electoral Commission shall be laid down by Law.
